I haven't gone through everything you have posted, but with this taking multiple month and you getting the point where you feel you need a lawyer, I suggest you bring this matter up with the department of insurance for your state. I did a quick Google search and came up with this:

Plead your case with them. If your insurance company is handling your claim in a less than professional fashion these guys should be able to assist you, or at the very least give you some sort of guidance.
