Well, my lawyer has accepted the case along with the pics of damage and bold print in the owner's manual that indicates to only tow with a flatbed. The case is still in litigation. True, I was parked, improperly, but I paid the $250 towing fee in cash up front prior to calling the police and he still refused to give me insurance info. He got me, but that does not give him the right to tow me improperly. I hope his $250 was worth it! Also, I blame the gf bc I wanted to wait in the car, but sometimes you can't win.

It is not possible for a tow to occur if, right or wrong, an occupant is in the vehicle to be towed.

^this is true! I was not in the vehicle when it was towed, but i am not sure about the op.
