I know all to well about ornery neighbors. One of my neighbors cut down 5 rhododendron bushes in my yard, valued at $45,000 total. The other used to let his 3 dogs bark constantly at all hours of the day and night, blatantly disregarding noise laws. Multiple neighbors of his have complained to the police and the town.. but they still bark. He also planted some stupid bushes on my yard and refuses to stop mowing the grass 3ft into my lawn.. I wouldn't care but he only does it like once every 3 weeks so he cuts it waaay too short so that 3ft is always yellow.. needless to say, I don't think too highly of my stupid neighbors

Just plant a line of trees on your side of the fence. Can you get evergreens?
Is there a law limiting how close to your property the fence can be? Like three feet or so? If he puts the fence right on your property line, you can make him dig it up. Also, you could go to the holes at night and fill them in with 6" of dirt and rocks so the fence won't be so secure.
You're fully in your right to put up a stepladder and look into his back yard too
If you really don't want the fence, take your covenant and take him to court. Someone has to enforce the rules, and if it makes you unhappy enough, it should be you.

My neighbor thinks he needs a 6' plastic wall fence "for privacy" (people could just look out their 2nd story windows right over his wall of plastic). My neighborhood convenants say if you want a fence a 42" picket fence is all that is allowed. Our township says 6' plastic is just fine. .....
I guess it helps that I'm the block gun nut/ hunter. Everybody is real polite to my face
