obviously you're no longer very fond of this neighbor person, so count it as a blessing that there will be a fence to reduce the amount of times you have to see this person's face.

Your neighborhood association hasn't enforced previous violations by letting them slide, if they try and enforce them on your neighbor they will have to have the other violations of the covenants dealt with as well. The covenants should have been enforced the first time there was a violation. As for an "office" in the house is that the primary address of the business, if not it shouldn't be in violation. Get a P.O. Box for the business.

I was going to let this thing die until last night when the fence sections were installed.
from what the District Justice told me, just because someone else got away with speeding in the past doesn't mean that everyone will get to speed.......
I sent this dick a certified letter telling him not to put up the fence. The rules are still rules as long as someone enforces.... so I apparently need to sue my home owners association which will then be forced to sue my neighbor..... I should be able to win fairly easily especially with the letters that I sent, etc.... well in advance of him installing the fence.
as for the business... it is registed to a PO box, but once in a while my wife does have a few clients stop...maybe 2 per month.... so we are going to talk to the DJ about that before we proceed.... I am allowed to break a small rule that doesn't effect anyone....
HAHA, thats not a fence, thats a wall of plastic!! Just wait till it cracks, yellows, and gets stained..Plastic fences look soo cheap. Why couldn't he at least have gotten a wooden fence.

FYI: In general you can petition the HOA for any waiver or any rule you'd like, the HOA has the right to issue a waiver even post violation. It will depend on the whos in the board. If that happens, which I would bet it will, you're out of options.He might be on the board if not he can get on the board next year since noone ever does it.
