I still think you will have trouble fitting that and I would recommend 10 +38 which will stick out 1/4" farther than now and you will have a bit more tire.
Or worst case get a 10mm spacer on the 38 and call it a day.

I know, after 9" you don't gain anything.
I've been thinking the 10" +38 is going to be the safest. I can upsize my rear tire a little to accomidate the wider rear fender or add a degree of camber and not worry about buckling the rear
