I had the exact problem on my 05 S2000 and it WILL get worse overtime. Scared the shit out of me everytime it happened. Not only it is dangerous because you might get rear ended but also embarrassing.. The dealer replaced the 1st and 2nd gear synchro under warranty. Have not experienced the same problem with my CR yet.

I hate to jump to a negative conclusion, but it sounds like the previous owner/owners abused your car a bit and wore out the synchro's. Try the fluid, check the plastic cup that seats the ball of the shifter first though. If that doesn't fix it, and I still think it will be your issue, your synchro's need to be replaced.

It is very likely the transmission fluid just needs changed. I had my 06 AP2 pop out of 2nd maybe 4-5 times in the last month. The transmission fluid definitely needed replacing, putting in fresh Honda MTF2 definitely solved the problem for me, not to mention making shifting into all gears much smoother. Slots into every gear much nicer. It is pretty likely that your tranny fluid has never been changed and just needs a refresh.
If that doesn't resolve it definitely check out the shifter cup but with a car that new I would be surprised if that was in bad condition. Don't even worry about a synchro being an issue until you have put in fresh fluid.
