GA does recognize DV, but even I agree that it is extremely flawed.


Seriously, my main concern is getting my car back 100%. If I can get it back in the same condition it was prior to the wreck, I'll be one happy camper. This car was a garage queen that hardly ever saw a weekday drive, til the other day of course.

OK, well it's up to you. But in 25 years of driving I've had two wrecks that were my fault, a couple of hit-and-runs, and about 8 wrecks that were somebody else's fault.

The only time I ever had to hassle with the insurance companies or had problems with them nickel-and-diming me were the two times I tried to claim third party. All the other times I have claimed first party from State Farm, and the service has been excellent.

Yeah that car will NEVER be the same. Hate to say it. Never seen a car in AS GOOD or BETTER condition after a wreck. And it sounds like the trucking companies insurance plan on dragging their feet. (If you settle with State Farm for X amount they will only pay SF X amount). In other words, they don't want YOU to push the issue. It's typical for them to do this. If you have a lawyer FRIEND, talk to them and see what they might reccommend.

Ask around to find the best body shop in your area. Take the car to them, with the pic's and have them check car top to bottom. Make sure they check the suspension, wheels, and that they do a 4 wheel alignment. Tell them you want all NEW OEM parts used. Be very clear on these points, and make sure the shop knows that: They'll help you with the insurance company if they're good.

Do NOT take any crap from the truckers insurance company because they will try to get you to use cheaper non OEM parts.

Well, the trucking company called me and they want to handle everything in house, they don't want to use their insurance company. They want me to get an estimate and FAX it to them. I don't know if this is a good thing or a bad thing. My State Farm agent said it's not uncommon for commercial companies to do this as they have high deductibles, and just to make certain I have a contingency with the trucking company to make sure if any additional damage is found during the repair, that it will be covered beyond the estimate, and of course I can always put it back in the hands of State Farm if I need to.

IMO, I still say to go through State Farm, but it's up to you. Depends on whether you like negotiations or would rather just have somebody else take care of it all for you and get on with your life.

OK, enough already! How many times do you have to say that??? You win!!!

Yeah, I chickened out at the last second as I was dropping my car at the body shop. I called my State Farm agent and opened a claim. I need to worry more about my car getting fixed right than I do putting a little extra $$$ in my pockets, that probably wouldn't buy me much. I do have to pay my deductible, and I have to pay 20% of the rental, but I "should" get that back when the trucking company pays State Farm.

I always have gotten the deductable money back, no problem. You should get the renatl money back too, but that might not be as automatic.
