I took it one step further and spoke to a manager, I told him the carfax report would decrease the car value and if they reimburse me for that, I would be more than happy. He agreed 100 percent, said that he would work with me, but only after the other insurance companies adjuster came out and looked at it. I also spoke to a lawyer who said it would take a call and a few letters for them to go ahead and total it, but I'm pretty sure the manager sees where I'm coming from.
I think it's pretty much in my hands whether or not I want too repair or total it.
I took it to a body shop who is going to run it through a sophisticated laser machine and tell me how bad/good it is.
good luck with the car. and be careful, that "lawyer" is only trying to get you to pay him a few hundred dollars to make that phone call and write a letter. to think the decision is in your hands would be overly optimistic =P

yeah it definatly doesnt looked totaled. shouldnt being a long term policy holder mean they will be more favorable to you? i mean just say youll move to statefarm or something
and omg statefarm charges an arm and a leg for insurance

Be sure that the estimate they use has 100% OEM Honda parts and not "equivalent" ones. I had someone rear-end me putting it at 70% FMV, but my insistence on OEM parts was the death-stroke that made them total it! 
Since this is not YOUR insurance, you are not at the mercy of their policies. Depending on the state, you can get diminished value, too.
If this were YOUR company, you would not get diminished value and would have to use "equivalent" parts if that was their STATED policy.
