Remember when the great great grandson of Van Gogh was murdered for making an anti-Muslim movie? A film festival in Belgium just announced that they won't be showing the movie, as they don't want to offend anyone.
It's the incrementalism and appeasement and civil rights watchdog weenies who are allowing these guys to get away with, well, murder.
It's like taking a great idea, like conservationism, and then twisting it until walking on a lawn is an offense against Mother Nature.
We need to be rational about the laws we make, just as we need to be rational about how we "process" these armed combatants. Taken too far, even a basic tenet such as civil rights can be taken too far.

As to your last paragraph, as quoted above, I agree completely, but I think there is a relationship here as well. I think as we've taken the human rights of the prisoners, we've also given up some of our rights. I think they've won on both fronts.
As long as we're talking about constitutionality, lets talk about our wonderrful new McCain-Feingold Campaign finance bill and the positive effect it had on our last election.
