I don't really know the answer to your last question. My level of expertise is more on the criminal than road traffic side. I would have thought that Recorded Delivery would be the obvious way to go. I suspect that the simple answer, is that on the police file there will a record of when the N.I.P. was sent out, and the onus will be on the recipient to satisfy the court that they didn't receive it. Guess the likely outcome!!
Being a little out of date, now, the fact that your son has recently had an NIP, confirms I think that they are still required.
Offences requiring an N.I.P.
Reckless, dangerous or careless driving
Exceeding the speed limit.
Failing to conform to a lawfully placed traffic sign.
Failing to conform to the direction of a constable engaged in the regulation of traffic.
Failing to stop after an accident.
It is required to be delivered in the following terms:-
"You will be reported for consideration of the question of prosecuting you for one or more of the offences of...(as in above list).
The N.I.P. notice can be delivered verbally by the constable at the time he knocks you off, which legally would negate the written N.I.P. requirement. In practise it was always sent out anyway.
Can't help any more than that guys... sorry!!
