You should file again on the last day and say the guy either didn't ship you anything or sent you a broken item. He will have no proof of shipping you anything so paypal will have to refund you.

if you sent the payment to a different address, 1 of 2 things will happen.

1. If the person has a Paypal account, they will receive the funds.

2. If the email address doesn't belong to a Paypal account, the funds are in limbo, and Paypal sends an email to that address telling them how to sign up for Paypal.

Now, if the person had a Paypal account like you say - you file a dispute saying you never received the item. Clearly, the person with the funds will not be able to provide any tracking information showing they shipped you your purchase.

Within 10 days, Paypal will refund you the money.
