Are tinted windows a moving violation?

Totally agree, moving violation is crap, just a bogus way to drum up fines and points for drivers. Yeah I have nothing against some tint (factory and light/medium aftermarket), but having that dark tint is my problem.


Yeah the rule is have your window down but that time between pulling them over, running the plates and when you go walk over to the vehicle gives plenty of time to whoever is inside.

You have to understand that radar detectors are completely illegal in some states and are easily removed from cars. Radar detectors aren't regulated by how accurate they are, so there is a blanket ban on them in some states (vs. tint, which is variable and easily measured).

So, ticketing someone because something is legal in their state when they come through your state is illegal and could almost be perceived as interfering with interstate trade. To the OP - I'd advise to get some legal help. Did you get your license back from him? I do not see how that is legal to confiscate someone's license for a non moving violation would be like taking your license for parking illegally, it doesn't make sense.

How do they expect you to get to court, leave the scene, etc.

I agree that the cop was out of line, but if you paid him cash to get your license back, and don't have any type of proof (unless the video in his patrol car was rolling), you don't really have any proof.

Was it an area that you drive frequently? Maybe the cop had seen your tint before? Much like how car enthusiasts notice cars that are unique, I'm sure cops do as well.
