Hiep, Have you talked to YOUR insurance company? They should be the ones that will handle this for you - that's what you pay them for.
Your comprehensive coverage should cover this damage and then your insurance company has the option of going after Farmers for reimbursement or after the driver of the car that hit you.

i actually am doing everything i can to avoid letting my insurance or the dmv know about the accident. i dont want anything that potentially can reflect my record negatively in the future. so i am working directly with their insurance, farmers, who is going to work directly with the autobody shop.

Hmmm. The DMV will have a record of it because of the police report. And your insurance company will be notified in due course.
If Farmers doesn't come through for you (due to that expired policy) then your insurance company is going to want to know why you didn't file a report with them.
Since it is not a chargeable accident on your record there doesn't seem to be a reason you wouldn't want your insurance company to know.

well there isnt an official police report filed, only a "traffic crash exchange report". the officers said it wasnt necessary to file one. and that any charges to her would be taken care of by the county through cititions. and as far as an accident report with the dmv, because i wasnt actually driving the vehicle, its considered as inflicted property damage is what i was told by the dmv office so i didnt have to file an accident report.
when i was on a policy with my parents many years ago, i had an accident that was the other drivers fault. consquently our rate still went up (state farm) so i then had to go get my own policy seperately. i wasnt sure if this was the case for all insurance companies, but at this point i didnt feel the need to have my insurance take action unless for some reason farmers doesnt take liability for the accident. i use esurance, with is an online based insurance company, i dont have an agent i can actually use as a resource, so you either manage your own account via internet or your call a 800#. and well, we know how that goes.

I understand where you are coming from on the insurance report.
When I was in college I was involved in an accident that was the other guy's fault. He was cited by the police and everything. In spite of that, MY insurance company (Allstate) cancelled me! That threw me into a high-risk category and it took me years of paying high premiums before I could qualify for a top-rated company.
So, I know why you would rather your insurance company didn't know about this.
