You have farmers ay?? I work for farmers but not in the claims side, just the corporate side. In Oregon, it is mandatory to have uninsured motorist bodily injury. However, uninsured motorist property damage which in Oregon, it is a $10,000 dollar maximum with farmers that can be waived by signing a UIM/PD waiver form. So the question is, do you have this coverage? IF not did you sign one at your agents office? Claims has to prove that you have signed the form and the agent has to keep it in there files or have it scanned in the image center (stored file in your household) . If the agent does not have it in file.....well...there you go....no proof, no signed waiver....It has to be covered. And if you did waive the form....remember this is a coverage that would cost you maybe $2-3 bucks a month at most and most people do not even bother to waive it because it honestly does not save you much. But since I do not work in claims so don't quote me 100% but just keep in mind about that waiver form and you'll be fine.
ps. If you do have the coverage then your deductible would be $200 bucks since they know who had hit you.

i am going to be calling farmers a little later today and see where they are at with the whole claim. so this is where it was last at, they wont accept liability as this moment until further investigation. being that, the vehicle itself at this point has been confirmed insured, just the driver had provided me with an expired card (the officer actually found it not the driver). but the driver had a suspended license, and no insurance of her own. so farmers still needs to talk to all parties involved including the couple witnesses, and has to confirm with the owner of the van, that in fact the driver has authorization to be using the car. however, the owner of the car hasnt been able to be contacted because last i heard he was still in jail.

granted she probably has 8 dollars in her bank account, rents an apartment, and is three months late with the rent. Oh and probably unemployed.

the damage.. $8,887.05
they were able to contact the owner of the car, he did put in a statement that he granted her authority to be driving the car, so farmers stepped in and wrote me a check.
as far as what i plan to do with the car itself is up in the air.. probably a part out thread soon to come.
