Section 59 Warning
I got this from a friend:-
Typically we use this power on people using the mini-bikes or car cruises and more recently people playing in the snow.
It’s also worth adding that a S59 can be giving to the person and/or the vehicle. So for example if I was playing in the snow with my car then me and the car could get a S59. If you were to play in the snow in my car and both get a S59 then that’s two for the vehicle and it can be seized.
Likewise if I was driving your car and got S59 warnings for me and your car then that’s two warnings for me and the vehicle at the time of the second warning can be seized.
It really is a great piece of legislation and sadly not used enough in my opinion.

I don't know Gritty, if it was me, i'd have ambled all the way along lane 1 till I found a convenient space in lane 2 rather than zipping off and then slowing down to join it.
Police around your area are getting a bit keen of late, Dad was saying they're hanging around a lot of the retail parks of late ( that big one on the outskirts of Middlesborough) picking up the local cruise brigade and using S59 offences extensively.
I've been careful going from the A1 to N'allerton the last few times because of this, Dad drinks with some of the HQ Traffic coppers and passed the warning on.

It sounds like, as BoM says, it can be effective if used under the correct circumstances. Getting my foot down on a sliproad is not being a nuisance to the public, FFS.

I wish I hadn't started this thread. My blood pressure is rising.

Just talking about it in the office and my assistants husband had a Skyline - he got stopped after exiting the Humber Bridge Toll Booth - they told him he was speeding. He told them he wasn't, just that his vehicle gets from a to b a bit faster than most and it's a 'little' bit noiser than your average Mondeo.
Left without anything other than a slap on the wrist and a narked policeman who was probably hoping for an uneduated chav to be behind the wheel.

Did hear on one case where plod's bully-boy tactics backfired; they started s.59-style driving up the arse of this woman, and the dozy bint panicked & slammed on the brakes. They had to drop the charges against her after the impact...
As much as it annoys ( and I do empathise AND sympathise) a policeman, and in particular traffic police count as expert witnesses so even if you took it further you'd still come off worse.
I think all you can do is take it on the chin because there is no effective means to complain about such a fudged law and all you'll do as you say is end up raising your own blood pressure.
This sadly is the problem with high revving cars, most people change up at 2500rpm - even if you go past at 6000rpm you're going to sound like an F1 car by comparison. None of us who bought an S2000 want to drive it around changing gear at < 6000rpm, if we wanted to do that, we would have all bought an MX5
I wonder if it's worth finding a Traffic cop and asking them what the law says about using a reasonable range of your engines ability on a public road as long as the speed is within limits.
