he is a very good friend. he dont care about the company, he works in claims and sees this all the time, ive got pics but cant upload them???

You can't upload them because you're a guest.

With the greatest of respect to your friend, if you challenge this decision it gets taken out of the hands of the claims monkeys and escalated to a higher level. Even then, if they still won't budge, you have the right to lodge a complaint with the Financial Ombudsman Service. It frequently overturns refusals by insurers to pay out. It costs you nothing to pursue your claim through it.......

As I said, it's up to you. If you can afford to write off the value of the car without a fight, you either have more money than sense or are so rich as to not to have to care about it!

your right, to be honest ive just never been in this position before and everyne i've talked to just told me to cut my losses and break the car! im gonna look into it a bit more but it does state that without mot, the policy is invalid, thats in black and white!

where exactly does it say that without an mot the policy is invalid?

the policy schedule

or the policy document?

and this is a standard Direct Line policy, yes?

must be someone else here with a DL policy who can confirm....

I'm with Direct Line. I'll check my policy when I get home. (Yes, highly modded but mods declared thus with high excesses, but otherwise looks like a standard doc IIRC).
