No offense but do you know what you're talkin about?

If you're convicted of killing someone the first time you'd be in prison. If you were acquitted then jeopardys attached which means you can't be tried for the same crime with the same evidence.
technically if u killed someone.. yes its murder and depends on the punishment if u survive death or not...

so that person is "suppose to be declared dead"""

but for some reason that person became alive.. u can kill that person and they can't do jack to you...

watch double jeopardy..... hehhehe... i'm just stoned right now.. not thinking straight

While on the subject of being fluid, this incident is the perfect example of how the school system works today. To quote you it is "coldhearted" and narrow minded as to how to mold a mind and how to prepare it for the real world. None of these rules teach anything important in the manner in which they are enforced. Because of this and because of my poor high school experience I tend to relate more toward the student then the school. Perhapse when im more narrow minded (not that you are Temin), and a parent, I will tent do side with the schools; unless I was that poor freaking mother in Iraq.
Correct, thats why I previously posted "stupid public schools".

The public education system, at least here in Miami, sucks. Rigid rules, most teachers don't care, constant violence (there seems to be a school shooting or stabbing at least once a week here) and too much focus on the useless FCAT exam. Where does preparation for college and life come in? In public schools they don't.

I was fortunate enough to attend a private high school and received the best education possible that prepared me for college and how to be successful in life.

This incident would have never occurred in my school because the teachers and administration have understanding and respect for its student body.

I wish that the government would offer tuition assistance programs to less fortunate parents who wish to send their kids to better private schools than being forced to send them to a public school due to a lack of choice.

I think people missed something from the last news story.

I'm guessing this is not the first time they have had to deal with a call from Iraq. I'm not sure how this actually went down but there is probably some truth to both sides. The teacher was probably not nice about him being on a cell call and the kid probably didn't respond well to being told to hang up or hand over the phone. Both sides screwed up.

Luckily for the 4 years my father was in 'Nam we didn't have to worry about it since there were no cell phones but since part of that time was at Pearl Harbor Elelmentary I don't think it would have been an issue.

How many kids do you think will try and use their cells in school now saying "it's my mom/dad/brother from Iraq" on the phone when all they are doing is making plans for that night's party.

I can't believe this conversation. The punishment seems harsh but we have no idea what that kid said to the teacher. The whole arresting thing is complete you can't arrest someone for using a cell phone or swearing. Kids should not have cell phones on them during school hours period. So he shouldn't have gotten the call in the first place. The flaw is in school policy, allowing the children to carry them in the first place. Once he got the call from any parental figure the school shouldn't have made him end the call. The teacher should've gotten on the phone to verify that it was indead his mother and that either it was an emergency or that this was a special case (which it was0 Then told the kid to go somewhere private to have the conversation. His mother should've been told to please not call him during school hours as it is disruptive more so that other children will start to make up excuses to get away with cell phone conversations that have no business taking place during school hours or she should make special arrangements with the school as to what time she will be calling during the school hours. Maybe calling the scholl first so that they can get this kid in the office while he's having the coversation so that other kids don't find a way to get around the no cell phone rule. Simple as that.

yes there are exception to rules..

you can kill a person.... for self defense

you can kill a person by setting trap in your business home, after local authority refuses to help you.. and you've been harass by same source of problem over and over...

you can kill a person for any reason you like, as long as you're convicted of killing that same person before and found guilty... ahem. double jeopardy...
This is actually true, so instead of charging you with murder they would charge you with manslaughter. actually the murder charge would be for a specific time and place of incident so this argument wouldn't fly in court.

You don't seem to understand, or have never had a close relative away at war. You don't know when the person will be calling, you don't know even if they will or can call. When that person gets that chance or minute to actually make that phone call they just do it. These soldiers are over there for extended periods of times, and have adjusted to the time zone over there, do you think they sit there and go "Hmm am I 8 hours ahead or 10?" maybe they are at work.. or at school?. No they don't.

I can speak from experience because my brother has been over in Iraq 3x's. When he called.. he called. We didn't question or ask him to not call at midnight or whatever time it was.. we were just very happy to hear his voice and that he was doing ok and as long as we got to talk to him those 5 minutes, it was good enough.

The idea that just because your situation isn't pleasant gives you the right to be rude is a fundamental flaw in society.

So i guess its alright to take a cell phone call while in a furneral home just because thats when they call.

Too bad, tuff $hitzels be apart of society and have some common courtesy, we'd all be better people and have a better society if we did.

But then again who cares.
