Doesn't sound too bad---I would pull the trunk liner as rosario717 suggests and determine the extent of the damage and whether a new panel was welded in or the old one repaired. If it was done at a reputable body shop, chances are the repair is fine. $3000 is not a lot of damage.
On the new top, that's a good thing--10 years is pushing the limits of the OEM top. (flame suit on---I'm sure they'll be lots of posts of folks with 00-02 AP1s with the original top who'll chime in saying theirs is perfect and will last another 20 years....)
I'd rather have one that's been in a minor accident and repaired properly in a quality shop than one that's been modded and returned to stock.

I would also run a carfax, and maybe get pics of the "hail damage" he is talking about before you make the trip.
other than that, doesnt seem like a bad deal, ap2 wheels are nice too.
